| Scope and Parties
Our core business is the money remittance market. We developed a service with which you, as an authorised member of our service, can send money to recipients from every computer in the world. The parties involved in this service are aws switzerland sa (as a processor), you as a sender, a distributor and a receiver. If you (as the sender of the money remittance) use our service a contractual relationship according to Swiss law is establish between you and aws switzerland sa.
Quality of Service
We work at best efforts and apply common accuracy. Usually the amount sent will be delivered within 24 hours. The first transaction will be executed after reception of your signed legal authorization form and your personal identification document. If within two weeks the remittance could not be executed, we will wire you the money back to your account, free of any charges.
Limitation of Responsibilities
In no event shall aws switzerland sa be liable for damages for delay, non- delivery, non-payment or underpayment for this money transfer, or any supplemental message, whether caused by negligence on the part of its employees or agents. In no event will aws switzerland sa be liable for any indirect, special, incidental or consequential damages. If aws switzerland sa accepts a money transfer or other negotiable form of payment from the sender, it assumes no obligation to make payment of the money transfer if the from of payment is uncollectible, nor does aws switzerland sa assume any liability for damages resulting from non-payment of the money transfer by reasons of such uncollectability.
Payments
The customer (both sender and receiver) who is using our service is in charge of respecting all kind of national restrictions. Due to the embargo, American citizens have to follow the restrictions from the US government that they can't send more than 100 USD per month and per person living in Cuba. We do decline all kind of responsibility or legal problems which will maybe occur to customers who do not respect the rules set by their national government.
The range of money transfers we do accept and deliver has to be between 50 and 1200 Euro. Amounts exceeding limits will not be processed.
The sender cannot revoke a transaction previously released. If a transaction can not be completed for a reason for which aws switzerland sa is not responsible, the sender remains liable to cover any caused fees for the unsuccessful remittance.
Refund
The receiver has to identify himself with a legal document (passport or identification card) and has to sign a receipt formula confirming that he or she has received the remittance. The remittance is always paid out in the local currency of the receiver. The credit card of the sender will always be billed in Euro. Total amounts will be also displayed as indication in the local currency of the sender, applying as reference the exchange rate provided by xe.com.
Duties of sender
The sender accepts the fees and tariffs applied. He confirms the truth of the identity of both, sender and receiver.
The sender may not disclose his account password(s) to anyone else, nor to use anyone else's password. Aws switzerland sa is not responsible for losses incurred by users as the result of their abuse of passwords. Please see our recommendation under security.
Privacy policy
The sender agrees that all related data shall be transferred to aws switzerland sa and its authorized agents for the purpose of the execution of the money transfer. Furthermore, he or she does also consents to the retention and use by aws switzerland sa and its authorised distributors of the data pertaining to this transaction for the purpose of complying with applicable legal requirements and to provide the customer with information about futures sales promotion. In no case the data will be delivered to a third party who may use them for marketing or promotional purposes.
